The newly appointed Chairman of the U.S. Commodity Futures Trading Commission (CFTC), Michael Selig, has indicated a pivotal shift towards enhanced federal oversight of cryptocurrency-linked prediction markets. This analysis was shared by Clear Street’s analyst Owen Lau.

In his inaugural public comments as CFTC Chair, Selig emphasized the importance of a unified federal strategy, aligning closely with the Securities and Exchange Commission (SEC) to drive innovation in blockchain-based markets.

During a recent joint SEC–CFTC Harmonization Event, Selig expressed that the priority would be on establishing clear and principled regulatory guidelines for the crypto space. Lau noted, “The objective is to implement clear and principled rules of the road for crypto.”

Introduction of “Project Crypto” Ahead of Congressional Developments

Selig’s remarks come amid ongoing discussions by lawmakers regarding broader market structure legislation, which aims to define whether digital tokens should be regulated as securities or commodities. This legislation will also clarify the jurisdictional boundaries between the SEC and CFTC.

Clear Street points out that the initiative — dubbed “Project Crypto” — is being launched even before Congress reaches a consensus on a crucial market structure bill.

Lau remarked that this proactive leadership is what the industry has been seeking for years, especially in light of the Senate Agriculture Committee moving forward with the “Digital Commodity Intermediaries Act,” which gained bipartisan support on the same day.

CFTC Moves to Mitigate Restrictions on Event Contracts

More importantly, Selig hinted at the CFTC’s readiness to take a stronger stance regarding the cloud of regulatory uncertainty hanging over prediction markets, which have faced increasing litigation and unclear guidelines.

Lau highlighted that Selig has instructed his team to retract the proposed 2024 event contracts rule that sought to prohibit political- and sports-related event contracts. He also called for the retraction of a 2025 staff advisory that advised firms against offering sports-related contracts due to ongoing court disputes.

Clear Street believes Selig acknowledges that the prior hands-off approach has led to more legal ambiguity rather than fostering market stability.

Developing New Regulatory Guidelines and Upholding CFTC Jurisdiction

In response to the need for innovation and competition, Selig has directed his staff to create a new regulatory framework for event contracts and to reevaluate the agency’s involvement in ongoing court cases.

Lau suggests that it is increasingly likely that the CFTC will defend its exclusive jurisdiction over commodity derivatives, including sports-related event contracts, in case of jurisdiction disputes.

“These actions could bolster the arguments being made by prediction market platforms in court,” Lau explained.

Potential Gains for Coinbase and Circle

Clear Street also mentioned that firms like Coinbase (COIN) and Circle (CRCL) could see significant advantages from these regulatory shifts, positioning prediction markets as a “greenfield opportunity.”

Coinbase recently rolled out prediction markets across all 50 U.S. states, while Circle’s USDC stablecoin is extensively utilized on crypto-specific platforms, such as Polymarket.

While uncertainties linger regarding the judiciary's acceptance of future CFTC rulemaking, Lau believes this shift signifies a positive development for the expanding prediction market ecosystem.
